Pratham Education Foundation (Pratham) is one of India's largest NGOs, with its registered office in Mumbai. Pratham has worked in the field of education for more than 30 years.

You are making a donation to Pratham through Pratham's online donation portal. Pratham will collect and process your personal data (as defined under the Digital Personal Data Protection Act, 2023) (Personal Data) to process your donation and, where applicable, issue you a tax exemption certificate, if you give your consent. The donation portal enables you to contribute to Pratham's education programmes securely using various payment methods (including RuPay, UPI, Visa and Mastercard).

This Consent Form and Privacy Notice is being issued in compliance with the Digital Personal Data Protection Act 2023 and the rules notified thereunder (DPDPA) and Pratham is committed to conducting the collection, use and processing of your Personal Data responsibly and in accordance with applicable Indian data protection laws.

1. Data Fiduciary

Pratham will act as the data fiduciary with respect to your Personal Data collected and processed under this Consent Form and Privacy Notice, which means Pratham will determine the purposes and means of processing your Personal Data. 2. Collection of Personal Data and purpose of processing

The Personal Data collected by Pratham on the donation portal, the purpose for which Personal Data will be processed, and the specific goods and/or services which will be given, is explained in the table below:

Collection of the Personal Data described above and marked with an asterisk (*) on the donation portal (first name, last name, email address, mobile number, address and PAN) is mandatory to process your donation and issue an 80G tax exemption certificate. Providing remarks is optional.

Access to your Personal Data is limited to Pratham’s staff who are directly involved in fundraising operations, donor communications, processing your donation and issuing your receipt.

Your Personal Data may be processed in accordance with law for any legally permitted grounds.

3. Sharing of Personal Data

Your Personal Data may be shared by Pratham with certain third parties mentioned below for the following purposes. Pratham does not trade or sell your Personal Data to any other organisation.

4. Withdrawal of Consent

You may withdraw your consent to the processing of your Personal Data at any time. Please contact Pratham's DPO at the contact details given in Paragraph 1 to withdraw your consent. After the receipt of your withdrawal request, we will verify your identity and your Personal Data will be deleted from Pratham's and its data processor's systems within 15 (fifteen) working days. We may retain your Personal Data for any legal compliances, including applicable tax and record-keeping requirements.

Pratham and its data processors will stop the processing of your Personal Data within 15 working days from the day you withdraw consent.

Any withdrawal of consent will not affect the legality of the Personal Data processed before the withdrawal, and will not reverse or affect any donation already processed. Any legally permitted grounds of Personal Data processing may continue to apply. 5. Data Retention

Your Personal Data will be retained for 8 years or as long as necessary to fulfil the purpose for which it was collected and to comply with applicable legal and regulatory requirements. For example, applicable tax laws in India require Pratham to retain your contact information and contribution details for prescribed statutory periods.

6. Rights of the data principal

You have the following rights in relation to your Personal Data. To exercise any of these, please use the contact details in Paragraph 1.

2. Right to correction of your Personal Data You may ask us to correct, complete or update your Personal Data. Email us with the correction, completion or updation request, giving adequate details. We will verify your identity and respond, aiming to correct, complete and update your Personal Data within 15 working days, with confirmation shared by the DPO or an authorised person of Pratham.
3. Right to erasure of your Personal Data You may ask us to delete your Personal Data. We will do so unless retention is required for the specified purpose or by law (for example, statutory tax record-keeping requirements). Email us with your erasure request. After receipt of your request, we will verify your identity and your Personal Data will be deleted from Pratham's and its data processor's systems within 15 (fifteen) working days, subject to retention of your data for any legal requirements.

7. Grievance Redressal

We may seek further information from you in order to address your grievance adequately. We will aim to resolve your grievance within 15 days, if we receive sufficient details and information on the grievance from you timely.

8. Complaint to the Data Protection Board

If you are not satisfied with our response to your grievance, you have the right to file a complaint with the Data Protection Board of India (Board).

Please first use our internal grievance mechanism (refer Paragraph 7) and allow us to respond before approaching the Board.

9. Consent

By submitting the donation form, you are requested to give your consent to:

(a) Pratham collecting, storing and processing your Personal Data as described in this Consent Form and Privacy Notice, and to Pratham's Terms and Conditions, in order to process your donation. You may deny consent as per your discretion, in which case Pratham will not be able to process your donation; and

(b) being contacted by Pratham by text or email about your donations, campaigns, and updates. This consent is optional and separate from consent given under (a) above; you may decline it and still proceed with your donation.

You may withdraw either of the above consents at any time in accordance with Paragraph 4 (Withdrawal of Consent) above or clicking ‘Unsubscribe’ to opt out of being contacted for your donations, campaigns, and updates.
